Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of Transport Plus (also referred to as Transport+) ("the Service"), a transportation management system provided by Jett Labs ("we," "our," or "us"), located at L0, Ewropa Business Center, Triq Dun Karm, Birkirkara, Malta.
2. Definitions
- "Customer" refers to the organization or individual that has contracted to use the Service (the transport operator)
- "User" refers to any individual who accesses or uses the Service
- "Driver" refers to any individual registered as a driver within the Service
- "Customer App" refers to the Transport Plus mobile app (
io.transportplus.app) - "Driver App" refers to the Transport Plus Driver mobile app (
io.transportplus.driver) - "Personal Data" means any information relating to an identified or identifiable natural person
- "Data Controller" refers, for operator TMS data, to the Customer who determines the purposes and means of processing personal data. Jett Labs is the controller for the marketing website, sales and waitlist enquiries, and Customer App accounts that we operate
- "Data Processor" refers to Jett Labs when processing operator TMS data on behalf of the Customer
3. Scope of these Terms
These Terms cover:
- The marketing website
- The operator web application
- Public trip, payment, and shuttle pages
- The Customer App
- The Driver App
Sections 6 to 13 are commercial terms between Jett Labs and the Customer. Website visitors and app users are also bound by the applicable parts of these Terms and by the Privacy Policy.
4. Website and App Use
4.1 Website
- Marketing content is informational and is not an offer or a contract for the Service
- Submitting a contact, integration, or waitlist form does not create a contract for the Service
- Demo booking is provided through Calendly. Calendly's terms apply to that booking
- Public trip, payment, and shuttle pages let you view or pay for a trip the operator has already created. They do not create bookings
4.2 App Users
- We grant you a limited, non-exclusive, non-transferable licence to use the Customer App or Driver App for their intended purpose. The software is licensed, not sold
- You must not abuse the Service, spoof or falsify location, scrape data, or interfere with other users
- Drivers should enable location tracking only when they agree to be located for work. While tracking is on, location may continue in the background, after the app is closed, and after the device restarts, until you turn tracking off or log out. Tracking cannot be turned off while a trip is in progress
4.3 Age
- App and website users must be 16 or older
- The Customer is responsible for any personal data about younger passengers that the Customer enters (for example school transport)
4.4 Accounts
- Customer App accounts may be created by the user. You can delete your account in the app under Settings. Deletion removes your Transport Plus login and saved trips. The school or operator still keeps the student and trip records they need to run the service
- Driver accounts are created by the Customer. To request deletion, ask the Customer or email [email protected]
- Operator users should ask the Customer or email [email protected]
5. Data Processing Agreement
5.1 Roles and Responsibilities
For operator TMS data, the Customer acts as the Data Controller and Jett Labs acts as the Data Processor. As Data Processor, we:
- Process personal data only on documented instructions from the Customer
- Ensure that persons authorized to process personal data have committed to confidentiality
- Implement appropriate technical and organizational security measures
- Respect the conditions for engaging sub-processors
- Assist the Customer in responding to data subjects' requests
- Assist the Customer in ensuring compliance with security obligations
- Delete or return all personal data after the end of services
- Make available to the Customer all information necessary to demonstrate compliance
5.2 Data Processing Details
The Service processes the following categories of personal data:
- Driver information (name, contact details, work schedules, location data, device diagnostics, cash logs)
- Customer and operator-user information (contact details, business information)
- Passenger and, where used, student information (name, contact details, date of birth, guardians, addresses, trip details, identity documents the Customer uploads)
- Payment information and payment metadata
- Location data
- Usage data
5.3 Sub-processors
We use the sub-processors listed in section 5 of the Privacy Policy, including:
- Cloudflare (file storage in Western Europe and map tiles)
- Postmark (email)
- Google (Firebase Cloud Messaging, reCAPTCHA, Maps/Places, fonts)
- Mapbox (static maps)
- Calendly (website demo booking)
- Revolut and, where enabled by the Customer, Stripe (payments)
- Xero (invoicing), where enabled by the Customer
- WhatsApp via WAAPI, where enabled by the Customer
- Fleet GPS vendors the Customer connects (for example Teltonika, HandsOn, Yipii / DazzlePanel)
- Gravatar and, if enabled, Sentry
- Cloud hosting providers in the EU
We will inform Customers of any intended changes concerning sub-processors.
6. Security Measures
We implement appropriate technical and organizational measures including:
- Data encryption at rest and in transit
- Two-factor authentication
- Web Application Firewall
- Regular security audits
- Access control and logging
- Regular backups
- Intrusion detection systems
7. Data Subject Rights
We will assist Customers in fulfilling their obligations to respond to data subjects' requests, including:
- Right of access
- Right to rectification
- Right to erasure
- Right to restriction of processing
- Right to data portability
- Right to object
- Rights related to automated decision making
8. Service Availability and Support
8.1 Service Level Agreement
- The Service is hosted with high availability across three geographic zones
- Regular backups are performed multiple times daily
- Support is available Monday to Friday, 9am to 5pm (CET)
- System monitoring is provided 24/7
8.2 Maintenance and Updates
- Scheduled maintenance will be communicated in advance
- Emergency maintenance may be performed as needed
- Updates and new features will be deployed with minimal disruption
9. Payment Terms
9.1 Pricing
- Pricing is based on the number of active and inactive drivers
- Billing occurs monthly
- Initial deposit equivalent to one year of expected usage is required
- Pro-rata charging applies for mid-month additions
9.2 Payment
- Invoices are issued on the 1st of each month
- Payment terms are NET 30
- Accepted payment methods will be specified on the invoice
- Late payments may result in service suspension
10. Termination
10.1 Termination by Customer
- Customer may terminate with 30 days written notice
- Customer data will be retained for 30 days post-termination
- Customer may request data export within this period
10.2 Termination by Provider
- We may terminate for breach of terms with 14 days notice
- We may terminate immediately for non-payment
- We may terminate for illegal use of the Service
11. Limitations of Liability
- Our liability is limited to direct damages
- Maximum liability is capped at 12 months of service fees
- We are not liable for:
- Loss of profits
- Loss of data
- Indirect or consequential damages
- Force majeure events
12. Intellectual Property
- The Service and all related software remain our property
- Customers retain ownership of their data
- No license is granted except as explicitly stated
13. Modifications to Terms
- We may modify these terms with 30 days notice
- Continued use after changes constitutes acceptance
- Material changes will require explicit consent
14. Governing Law
These Terms are governed by the laws of Malta and EU regulations, including GDPR.
